These Terms & Conditions ("Terms") govern your use of davitofinance.com and all content, courses, products, and services offered by DavitoFinance ("we," "us," "our"). By accessing our site, creating an account, enrolling in a course, purchasing a product, or joining our referral program, you agree to be bound by these Terms, alongside our Privacy Policy, Disclaimer, and Refund Policy. If you don't agree, please don't use our site or services.

1. Eligibility

You must be at least 18 years old to use DavitoFinance, enroll in a course, or join our referral program. By using our site, you confirm that you meet this requirement.

2. Accounts

Some parts of our site (including course access and the referral program) require an account. You're responsible for keeping your login details secure and for all activity under your account. Let us know right away if you suspect unauthorized access. Please provide accurate information when creating an account; we may suspend accounts with information we believe is false or misleading.

3. Our Services

DavitoFinance offers educational content and products related to cryptocurrency, DeFi, and forex trading, including:

  • A blog covering crypto, DeFi, and forex topics
  • Structured courses, including our crypto/DeFi trading course and forex trading course
  • Books and digital products available through our Shop
  • A Telegram community, with free and paid premium tiers
  • A referral/commission program for enrolled students

We may add, change, or discontinue any part of our services at any time.

4. Course Enrollment & Access

When you enroll in a course (including through our default enrollment page) you get access to that course's content for as long as we continue to offer it, subject to these Terms. Course access is personal to you; you may not share your login, redistribute course materials, or allow others to access the course through your account. We may revoke access if we determine these Terms have been violated.

5. Payments & Pricing

Payments for courses, books, and digital products are processed through Paystack or Flutterwave. Prices are listed in the currency shown at checkout and may change at any time, the price you pay is the price shown when you complete your purchase. You're responsible for any additional fees your bank or payment provider charges on top of our listed price.

6. Refunds

Refunds are governed by our separate Refund Policy. In short: books and software/digital access are non-refundable, and courses have a 7-day refund window subject to a 25% content-consumption limit. See the full policy for details.

7. Intellectual Property

All content on DavitoFinance (including course materials, blog posts, videos, graphics, and branding) is owned by DavitoFinance or used under license, and is protected by copyright and other intellectual property laws. When you enroll in a course or access our content, we grant you a personal, non-transferable license to use it for your own learning. You may not copy, redistribute, resell, or publicly share our course materials or paid content without our written permission.

8. Referral & Commission Program

If you're an enrolled student, you may be eligible to join our referral program and earn commissions on sales made through your unique referral link.

  • Eligibility requires an active DavitoFinance enrollment and acceptance of these Terms
  • Commissions are calculated and paid according to the rate and schedule described when you join the program, and may change with reasonable notice
  • You may not refer yourself, use fraudulent, misleading, or spam-based tactics to generate referrals, or misrepresent DavitoFinance, its courses, or expected results when promoting your link
  • We may withhold or reclaim commissions tied to fraudulent, abusive, or policy-violating referrals, and may suspend or terminate a participant's access to the referral program at our discretion
  • Participation in the referral program does not make you an employee, agent, or partner of DavitoFinance

9. Telegram Community & Acceptable Use

Our Telegram community (free and premium) is part of the DavitoFinance experience, but is also subject to Telegram's own terms of service. Within our community, you agree not to:

  • Harass, threaten, or abuse other members
  • Share spam, scams, or unrelated promotional content
  • Impersonate DavitoFinance, its founder, or other members
  • Share, sell, or redistribute premium content outside the community

We may remove content or remove members who violate these rules, at our discretion.

10. User-Generated Content

If you submit comments, testimonials, or other content to us (including on our blog, social channels, or community) you grant DavitoFinance a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our business, including in marketing. You're responsible for making sure anything you submit doesn't violate any law or infringe on anyone else's rights.

11. Prohibited Conduct

Across our site, courses, and community, you agree not to:

  • Use our services for any unlawful purpose
  • Attempt to access accounts, data, or systems that aren't yours
  • Interfere with or disrupt the operation of our site or services
  • Scrape, copy, or reproduce our content at scale without permission
  • Misrepresent your identity or affiliation with DavitoFinance

12. Disclaimers & Limitation of Liability

Our content is educational, not financial or investment advice - see our full Disclaimer for details on the risks of crypto, DeFi, and forex trading, and the limits of our liability. To the fullest extent permitted by law, DavitoFinance provides its site and services "as is," without warranties of any kind, and is not liable for indirect, incidental, or consequential damages arising from your use of our services.

13. Indemnification

You agree to indemnify and hold DavitoFinance and its founder harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of our services, or infringement of any third party's rights.

14. Termination

We may suspend or terminate your access to any part of our services (including course access or referral program participation) at our discretion, particularly if we believe you've violated these Terms. You may stop using our services at any time.

15. Third-Party Links & Services

Our content links to third-party platforms, exchanges, brokers, and tools. We don't control these third parties and aren't responsible for their content, practices, or availability.

16. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continuing to use our services after changes take effect means you accept the update.

17. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of our services will be handled under that jurisdiction's laws, without regard to conflict-of-law principles.

18. Severability & Entire Agreement

If any part of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, alongside our Privacy Policy, Disclaimer, and Refund Policy, make up the entire agreement between you and DavitoFinance regarding your use of our services.
